Berry seeks return to shared custody arrangement

Published 6 October 2026

Halle Berry has asked a Los Angeles court to restore a 50/50 custody arrangement for her son with Olivier Martinez, give her final authority to break parenting-decision deadlocks and require Martinez to attend court-ordered therapy. Martinez has asked the court to reject her requests, citing a temporary domestic-violence restraining order he obtained against Berry. The court’s decision was not reported in the supplied accounts. Berry’s request seeks to reinstate an arrangement she says the parents had in August 2023. In her filing, she alleges Martinez has made unilateral decisions about their son Maceo’s education and extracurricular activities and has not cooperated over his educational and psychological needs. She says those disagreements have affected Maceo’s welfare and her relationship with him. The allegations are Berry’s claims in court papers, not independently established findings. Berry also says Maceo has returned from visits with Martinez angry and combative, and that it took two to three days for him to readjust at home.
