Temporary Order Limits Halle Berry’s Visitation With Son

Published 8 October 2026

A temporary court order has limited Halle Berry’s visitation with her 12-year-old son, Maceo, after his father, Olivier Martinez, accused the actress of physically assaulting the boy. The allegations have not been established in the material available, and Berry is seeking to restore a previous custody arrangement. Martinez obtained the temporary restraining order on October 1, according to the account of the dispute. The order suspended a 2023 agreement that provided for equal shared custody and gave Berry tie-breaking authority, the account said. Her court-ordered visitation is now limited to two days a week and every other weekend pending a hearing reported as expected on October 16. In a court filing, Martinez alleged that Berry grabbed Maceo by the neck and choked him during an incident on September 26. He also cited earlier alleged episodes, including an incident five years ago in which he claimed she struck the boy, and an incident about 10 years ago in which he said she threw a plate and cutlery toward him. These are allegations in Martinez’s filing, not independently established findings.
