Sony Seeks Dismissal of PS5 Tariff Refund Lawsuit

Sony Interactive Entertainment has asked a federal judge in California to dismiss a class action lawsuit seeking to force the company to pass on hundreds of millions of dollars in tariff refunds to PlayStation 5 buyers. In a motion filed on September 1, 2026, Sony's lawyers argued that paying a fair market price for a voluntarily purchased product does not constitute a legally recognized injury. The company expects to receive approximately $508 million in refunds from the U.S. government after the Supreme Court ruled in February that the 2025 tariffs were illegal. The lawsuit, filed in May 2026 by plaintiffs Amorey Walker and Bryce Foster-Quarles, contends that Sony would be unjustly enriched if it kept both the higher prices charged to consumers and the subsequent government refunds. The plaintiffs seek partial reimbursement for U.S. buyers who purchased a PS5 since August 1, 2025. Sony's legal team countered that the claim linking tariffs to the August 2025 price increase is "speculative and illogical." They pointed to other potential factors, including inflation, currency fluctuations, component costs, logistics, competition, and demand.
