Madlanga Commission orders Khan to testify or face medical evaluation

The Madlanga Commission of Inquiry has ordered suspended Crime Intelligence deputy head Major General Feroz Khan to testify in person on September 28, 2026, or undergo an independent medical evaluation to determine if he is unfit to appear. The ruling, delivered on September 1, 2026, by Commission Chairperson Justice Mbuyiseli Madlanga, came after Khan failed to appear as scheduled, with his legal team citing injuries from a June shooting. Khan, along with Gauteng Hawks Head Ebrahim Kadwa and businessman Tariq Downes, faces separate corruption charges in the Kempton Park Magistrates Court. His testimony before the commission, which is probing criminality within the justice system, was originally scheduled for July 1, 2026, but was postponed after he was shot in Houghton, Johannesburg, on June 28, 2026. He was treated at Milpark Hospital and discharged in mid-July. In Tuesday's proceedings, Khan's advocate, Mohammed Vally, argued that his client had been readmitted to a Johannesburg hospital and that the stress of testifying could aggravate his condition. Vally warned that an independent medical examination could further harm his client. "This could worsen his conditions," he said.
