KJ Biermann Pleads Not Guilty, Seeks Juvenile Court Transfer
Kroy “KJ” Biermann has pleaded not guilty to seven felony charges in Fulton County Superior Court, while his attorney is seeking to have the case transferred from adult court to juvenile court. No ruling on the transfer request has been reported, and the charges have not been proved in court. Attorney Jason Sheffield filed the plea on October 5 and waived Biermann’s formal arraignment, which had been scheduled for October 14. The defense requested a hearing on the transfer question before adult-court pretrial or trial dates are set. It also asked for 10 days after receiving discovery materials to file further motions. The charges stem from an alleged April encounter with a female classmate at a gym in Alpharetta. The indictment lists aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment and three counts of sexual battery against a child under 16. The alleged victim’s account is part of the allegations against Biermann, who has pleaded not guilty. The defense has argued in earlier filings that the case should be handled in juvenile court because Biermann was 14 at the time of the alleged incident.
