Hershey Updates Reese’s Pumpkin Packaging Disclaimer
The Hershey Co. has updated the packaging for Reese’s Peanut Butter Pumpkins to clarify that the carved jack-o’-lantern face shown on the wrapper is not on the candy, following a lawsuit over the product’s appearance. The company has not confirmed that the legal case prompted the change. Product images on Hershey’s website show the new wording, “Carving not on actual product,” on the front and back of the seasonal candy’s packaging, beside an image of a pumpkin with a carved face. The label replaces the earlier phrase “Decorating Suggestion.” The change follows the dismissal of an amended lawsuit brought by Florida consumers Nathan Vidal and Eduardo Granados. On September 16, 2026, U.S. District Judge Melissa Damian dismissed the complaint, ruling that the plaintiffs had not established financial injury or shown they paid more for the candy because it lacked the pictured carving. The plaintiffs alleged that the packaging misled them and said they bought the candy for the novelty of its depicted design. They claimed they would not have purchased it, or would have paid less, had they known the chocolate pumpkin had no carved face. The suit sought $5 million.
