CNN, MS NOW and Politico seek continued White House access

CNN, MS NOW and Politico are asking a federal judge to extend an order blocking the White House from restricting their reporters’ access while the organizations’ lawsuit proceeds. The temporary order restoring their credentials is due to expire Thursday, October 8, leaving U.S. District Judge Timothy Kelly to consider whether to grant a preliminary injunction for the duration of the case. The three organizations sued after the White House revoked press credentials for their journalists. Kelly issued a temporary order on September 24 requiring access to be restored. In his ruling, he found the outlets were likely to succeed on their claim that the administration had denied them due process by imposing the restrictions without adequate advance notice or an opportunity to respond. The organizations say the restrictions were retaliation for coverage the president disliked and violate First Amendment protections as well as due-process requirements. Their lawyers are seeking continued protection, arguing the White House could reinstate the ban if the temporary order expires.
