California billionaire tax leads in poll but faces nullification threat

A new poll shows a slim majority of California likely voters support Proposition 40, a proposed onetime 5% wealth tax on billionaires, but the measure faces a significant threat from two competing ballot initiatives that could nullify it. The survey by the Public Policy Institute of California, released this week, found 52% of likely voters favor the billionaire tax, while 46% oppose it. However, the same poll indicates strong support for Propositions 41 and 42, which were placed on the ballot by opponents of the wealth tax. Proposition 41, which would subject new taxes to the state's existing spending limit, is supported by 51% of likely voters. Proposition 42, which would prohibit new taxes on financial assets and personal property other than real estate, has 54% support. Under California's constitution, if two competing measures both pass, the one receiving the most yes votes becomes law. The text of Propositions 41 and 42 specifies that if either receives more votes than Proposition 40, the billionaire tax would be nullified. This creates a complex scenario where the tax could pass with a majority yet still be defeated by a competing measure with a larger majority.
