Judge declines to block Trump birthright citizenship order

Published 28 August 2026

A federal judge on Friday declined to immediately block President Donald Trump's revised executive order that seeks to narrow the scope of birthright citizenship, though she sharply questioned its legal foundation and allowed for a swift new challenge. U.S. District Judge Deborah Boardman in Greenbelt, Maryland, rejected a request for a temporary restraining order from immigrant rights advocates, stating that their existing lawsuit did not address the new directive signed by the president on August 6. The decision marks a temporary setback for the coalition of immigrant families and advocacy groups who had successfully challenged Trump's initial 2025 order.
