Judge Blocks Trump's New Birthright Citizenship Order

A federal judge on Wednesday blocked the Trump administration from enforcing a new executive order that sought to limit birthright citizenship, marking another legal setback for the president's efforts to redefine who qualifies as a U.S. citizen at birth. U.S. District Judge Deborah Boardman issued a preliminary injunction against the order, which was signed in August and aimed to deny citizenship to children born in the United States to parents classified as "alien enemies" or who entered the country through what the administration termed a "commercial transaction" to secure citizenship. The ruling, issued in Greenbelt, Maryland, halts enforcement of the new policy for a class of plaintiffs who would have been denied citizenship under a previous, broader executive order from President Donald Trump's first days in office. That initial 2025 order, which sought to end birthright citizenship for children born to parents unlawfully present or on temporary visas, was struck down by the Supreme Court in a June 30, 2026, decision. The high court found the earlier directive violated the 14th Amendment's citizenship clause.
