Florida Sues Netflix Over Data Tracking and Child Privacy
Florida has filed a lawsuit against Netflix, accusing the streaming giant of secretly tracking user data, including the viewing habits of children, and using that information to build an advertising business. The complaint, lodged by Florida Attorney General James Uthmeier, alleges that Netflix violated the Florida Digital Bill of Rights and the state's Deceptive and Unfair Trade Practices Act. According to the lawsuit, Netflix marketed itself to families as a refuge from Big Tech surveillance, promising an ad-free platform and claiming it did not collect user data or exploit users with advertising. State prosecutors contend this was a "bait-and-switch," as the company allegedly monitored devices, locations, search histories, and viewing habits, including activity on profiles designated for children aged 12 and under. The suit claims that Netflix's advertising business, launched in November 2022, contradicted earlier privacy representations and allowed advertisers to target Florida households based on demographics and lifestyle information without required consent.
