Emmitt Smith sued over $2.5M alleged fraud

A civil lawsuit filed in Delaware accuses former NFL star Emmitt Smith and his business partners of defrauding a Native American economic development group out of $2.5 million in a scheme allegedly connected to a Texas solar project. The complaint, filed on August 31, 2026, in the Delaware Court of Chancery, centers on a loan made in 2023 that the plaintiff claims was diverted to pay other debts instead of funding the promised venture. The lawsuit was brought by Kituwah LLC, the investment and economic development arm of the Eastern Band of Cherokee Indians. It names as defendants Smith, his business partner David Mosley, their company 4-13 Solutions Inc., and several other related entities.
