DOJ Sues Ohio Court Over Immigration Arrest Rule

Published 26 August 2026

The U.S. Department of Justice filed a federal lawsuit on Tuesday against the Franklin County Municipal Court in Ohio, challenging a local rule that prohibits federal immigration agents from making civil arrests at or near the courthouse without a judicial warrant. The lawsuit, filed in the U.S. District Court for the Southern District of Ohio, targets Local Rule 2.10, which states that individuals attending court proceedings or conducting lawful business cannot be subjected to civil arrest on courthouse property unless officers carry a warrant signed by a judge.
