Appeals Court Rejects McIver's Immunity Claim in Assault Case

A federal appeals court on Wednesday rejected U.S. Rep. LaMonica McIver's bid to dismiss criminal charges against her, ruling that two of three counts stemming from a 2025 confrontation with federal officers at a New Jersey immigration detention center are not protected by congressional immunity. The decision allows the Justice Department to proceed with the most serious portions of its case against the Democratic lawmaker. The ruling by the 3rd U.S. Circuit Court of Appeals, issued in a 2-1 decision, stems from an incident on May 9, 2025, at the Delaney Hall immigration detention center in Newark.
